Terms of Service

These Terms of Service ("Terms") govern your use of Culture Corner at https://culturecorner.elevaredigital.io/, a service operated by Elevare Digital NJ ("Culture Corner," "we," "us," or "our"). By accessing or using the service, you agree to these Terms and our Privacy Policy.

1. The service

Culture Corner is a creator-controlled web application that allows eligible users to connect their own TikTok account, select an original video, enter or edit a caption, confirm their rights, and send the video to their own TikTok inbox as a draft through TikTok's Login Kit and Content Posting API. Culture Corner does not automatically publish transferred drafts. TikTok provides the final editing, moderation, privacy, and publishing experience.

2. Eligibility and authority

You must be at least 18 years old, legally capable of entering a binding agreement, permitted to use TikTok, and compliant with the laws applicable to you. If you use Culture Corner for an organization, you represent that you have authority to bind that organization. You may not use the service where prohibited by law or platform rules.

3. TikTok authorization and account security

You must connect a TikTok account you are authorized to control. You are responsible for your TikTok account, the security of your devices, and all actions you initiate. Do not share authentication credentials or attempt to connect another person's account without permission. You may disconnect Culture Corner or revoke access through TikTok at any time.

4. Your content and license

You retain ownership of your videos, captions, and other content. You grant Culture Corner a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and technically modify your content only as necessary to provide, secure, troubleshoot, and improve the user-requested service. This license ends when the content is deleted from our systems, except for limited backups and records lawfully retained under our Privacy Policy.

You represent and warrant that you own or have all necessary rights, licenses, releases, and permissions for the content, music, images, voices, people, locations, trademarks, and claims included in your upload; that your caption is accurate and not misleading; and that the content and requested transfer comply with law, these Terms, TikTok's terms, Community Guidelines, and developer policies.

5. Prohibited conduct

You may not use Culture Corner to:

• Upload unlawful, infringing, deceptive, defamatory, hateful, harassing, dangerous, exploitative, sexually abusive, or privacy-invasive content.
• Impersonate another person, misrepresent affiliation, manipulate engagement, distribute spam, or evade TikTok moderation or platform limits.
• Upload malware, attempt unauthorized access, probe or disrupt the service, scrape data, reverse engineer protected components, or misuse access tokens.
• Remove or circumvent copyright notices, watermarks, consent mechanisms, security controls, or platform restrictions.
• Use the service for automated mass posting, surveillance, advertising profiles, data brokerage, or any purpose beyond the user-directed creator workflow.

6. User control and publishing

You must intentionally initiate each transfer. You are responsible for reviewing the resulting TikTok draft, selecting its privacy settings, making any final edits, and deciding whether to publish it. TikTok may review, limit, reject, mute, restrict, remove, or otherwise act on content under its own policies. Culture Corner cannot guarantee upload acceptance, distribution, reach, engagement, or continued availability.

7. Third-party services

TikTok and any other linked services are independent third parties. Their products are governed by their own terms and privacy policies. Culture Corner is not TikTok, is not endorsed by TikTok, and does not control TikTok's systems, policies, availability, or decisions. “TikTok” and related marks belong to their respective owners.

8. Privacy

Our Privacy Policy describes the information we collect, how TikTok data and upload content are processed, retention and deletion practices, service providers, safeguards, and your choices. By using the service, you acknowledge that processing as described there.

9. Suspension and termination

You may stop using the service and disconnect TikTok at any time. We may suspend or terminate access, block an upload, or remove data when reasonably necessary to address suspected misuse, security risk, legal obligations, platform requirements, repeated failures, or violations of these Terms. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, indemnity, and dispute terms—will survive.

10. Changes and availability

We may update, restrict, suspend, or discontinue any part of the service, including to respond to changes in TikTok's APIs or policies. We may revise these Terms by posting an updated version and effective date. Continued use after the updated Terms take effect constitutes acceptance where permitted by law.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTURE CORNER IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTURE CORNER AND ELEVARE DIGITAL NJ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOST OPPORTUNITY, REPUTATIONAL HARM, OR TIKTOK ACTIONS ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM. These limitations do not apply where prohibited by law.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Culture Corner, Elevare Digital NJ, and their personnel from claims, losses, liabilities, damages, and reasonable costs arising from your content, your use or misuse of the service, your violation of these Terms or applicable law, or your infringement of another person's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought exclusively in the state or federal courts located in New Jersey, and each party consents to their jurisdiction. Before filing a claim, please contact us and allow 30 days for an informal resolution attempt.

15. General terms

These Terms and the Privacy Policy are the entire agreement concerning Culture Corner. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the service. No agency, partnership, employment, or joint venture is created.
